Retail clerk with epilepsy not protected by ADA
A shoe salesman who was often required to work alone in the store, and who suffered repeated epileptic seizures while on the job, was not protected from being fired by the Americans with Disabilities Act. The Fourth Circuit Court of Appeals ruled that the company had a right to terminate his employment, even though he twice had received Employee of the Month awards, because of the danger to himself and others, and his inability to do an essential function of the job, namely provide store security.
