Who's liable if we rip off the temp agency?
What are the legal consequences of hiring a temporary employee away from the temp agency without informing that temp agency? Who is liable?

The question of liability would depend upon the contracts with the agency signed by the employer and the employee. If there was no agreement, you could do whatever you want. My guess is that both the employee and the employer signed agreements to notify the agency; therefore you'd both be liable.
