Can we fire an executive who quits?

If a senior level presents his 90 day resignation stating that he is providing the business time to hire his replacement, does the company have legal obligation to honor it?

Rita Risser's response:

I believe a company can terminate an individual under these circumstances. Senior people are expected to have an absolute duty of loyalty to the company. Presumably, this person is looking for employment with your competitors. It may be in your best interest to limit the amount of company confidential information revealed to this person.

For lower-level employees, firing them after they have given notice is a tough call. However, if you pay them through the notice period, then there is probably no liability.
