Should an employer accommodate an applicant who has a learning disability manifested when taking standardized tests? 01-07-01

Rita Risser responds:

Yes. The Americans with Disabilities Act applies to people with learning disabilities. The regulations specifically require reasonable accommodation for tests. Since standardized tests have very little relevance to a person's actual job duties, the entire issue of even using such tests should be seriously evaluated by your legal department.
