Help! The boss cut a peephole in the bathroom! 03-06-02

Our boss has cut a hole in a public restroom wall. There is another hole on the other side of the wall. We think that this hole was cut mainly for the purpose of spying or listening in on conversations. Although the hole is near the ceiling in both rooms, we are wondering if this is legal.

Ann Kiernan replies:

WOW! This sounds like a serious invasion of privacy for workers and members of the public who use that restroom. If the boss records the conversations he hears, that's an illegal wiretap. If someone using the toilet can be observed through the hole, that probably violates local criminal laws against "Peeping Toms".

I suggest you confront the boss, and if that doesn't work, you may actually be able to call the police. A local employment attorney can help you sort through your options.
