Does Degree=Salary? 06-16-02

I have a B.S from a California State University. My current employer does not want to make me salary. I don't qualify because, according to them, I need to have a professional degree. Is that true? Thank you

Ann Kiernan replies:

Whether you are paid as a salaried (exempt) employee or an hourly (non-exempt) employee depends entirely on what you do at work, not on what degree you have. If you spend more than half your time doing professional, managerial, or high-level administrative work, you are exempt from receiving overtime, and can be paid a steady salary, no matter how much you work. Otherwise, you are entitled to overtime.

If you're an employee who's been a victim of a layoff or firing, find out whether your rights were violated with our Wrongful Termination Guide.
