Question & Answer

After working 5 years, can I be fired for a felony I put on my application? 09-10-02

I've been working for 5 years with an agency that's contracted through the state Department of Mental Health. On my application I wrote that I had a felony conviction, but they hired me anyway. Now they have fired me because of this old conviction. I feel I was did wrong. What should I do about this?

Rita Risser Replies:

It definitely sounds like you were treated unfairly. Whether it is illegal in your state is another question, but it should be! The argument would be that this is a wrongful termination in violation of the covenant of good faith and fair dealing. Not every state recognizes the covenant, and those that do might not apply it to this situation.

I suggest you immediately contact a local attorney and get some advice. I'm willing to bet your rights were violated.

Best of luck.
