Can company hire a private investigator to discover an affair? 05-11-2004

I work in the HR department. I have heard several rumors that one of our Executive Managers is having an affair with one of his female direct reports and she has been promoted twice in 2 1/2 years. We don't have absolute proof and we were wondering if we could hire a private investigator to obtain any proof of an existing relationship. The problem that we are facing is either a potential sexual harassment suit or favoritism directed toward one employee.

Rita Risser replies:

Yes, you can hire a private investigator. You are right to be concerned about this situation. However, it would be wise to get top management buy-in before you hire an investigator. Once you have the information, you want to be able to act on it. Without management support, you may not be able to act, which would put the company in a worse situation.

Companies must take "all steps necessary" to prevent harassment. Meet your legal requirements with our program, Respectful Workplace.
