Employee is recruiting others for a class action suit - can we fire him? 03-09-2005

I have an employee who is undergoing a workers compensation claim and is speaking to other employees within the company about joining him in a class action suit and planning on suing the company. He is an "at will" employee. Is this grounds for firing him?

Rita Risser replies:

No this is not grounds for firing him - it is a very good way to create a wrongful termination case! You can make sure he is working (instead of talking) but other than that, there's not much you can do. If it makes you feel better, there is no such thing as a class action workers comp case, and it would be an unusual attorney who would be interested in suing such a small company (30 employees).
