Do we have to pay hourly employee who answers cell phone during off hours? 05-03-2006

If I issue a cell phone to an hourly employee to be contacted at any time by his co-workers, do I have to pay for the time he is on the phone?

Rita Risser replies:

Yes. And if he already has worked more than 8 hours in a day or 40 hours in a week, you also have to pay him at the overtime rate.
