Employee refuses to go on FMLA - what should we do? 09-06-2006

What can a company do if a employee is injured and cannot work, but refuses FMLA? Do we continue benefits, keep his job position open for him when he returns? I need to know what the employer's responsibilities are when an employee refuses FMLA but will not be able to work for a long period of time because they are hospitalized.

It's not up to the employee's choice. You put them on FMLA.
