Question & Answer

Can they make me retire? 09-23-2011

Our workplace is dismissing employees, either firing or encouraging people to retire. What are the steps to take if I'm called in and they want me to retire? Getting a different job will be difficult for me. Is workman's compensation an option? Yikes!

Ann Kiernan replies:

Unless you are a corporate bigwig, or an airline pilot, air traffic controller, first responder, or military member, mandatory retirement is illegal age discrimination. Unless you have been injured or exposed to hazardous substances on the job, workers' comp is not applicable here.

To learn more about your rights, you can start by reviewing the information in our Wrongful Termination Checklist, and then you may want to consult a local employment law attorney. If you do not know one, you may want to search your state's listings at the National Employment Lawyers Association, or to contact your local bar association for a referral. Good luck.
