Part II of Managing Within the Law is a one-day program for experienced and new executives, managers, supervisors and leads. It can be taken together or separately from Part I of Managing Within the Law. This workshop results in legally astute managers who can confidently navigate the ongoing challenges of accommodating employee needs while meeting their production and output objectives. Key areas covered include leaves of absense, corporate ethics, privacy, overtime pay, exempt versus non-exempt status, contractor and temporary employee rights, internet and email issues, managing telecommuters, and employee health.

Participants will learn to:

  • Manage their staffing levels while correctly classifying exempt, non-exempt, contractor, telecommuting, and temporary employees according to the state and federal law.
  • Respond appropriately to requests for leave, with a practical working knowledge of company, state, and federal leave of absence and wage and hour policies.
  • Understand the Americans with Disabilities Act (ADA) and reasonable accommodation
  • Recognize the warning signs of employees facing personal challenges such as workplace injuries, environmentally caused illness, drug and alcohol abuse, stress, and respond appropriately
  • Maintain excellent ethics management practices with respect to insider trading, company confidential information, intellectual property, conflict of interest, antitrust, foreign corrupt practices, company records, financial reporting, gifts and entertainment, and political activity
  • Appropriately balance the employee’s right to privacy while enforcing the organization’s electronic communication policy and its right to protect the safety and well-being of its workforce through weapons search, drug testing, computer system searches, and electronic communication audits
  • Quickly identify situations needing additional support from HR or legal experts

Your organization's policies and procedures, video vignettes, small group discussion, case studies and extensive Q & A. Our attorney-trainers are skilled facilitators with years of experience in the courtroom and the classroom.

Accreditation:
Fair Measures, Inc. certifies that this program has been approved for 6.5 MCLE credit hours by the State Bar of California.
