Hello, I have been working as an independent contractor at a group practice. The therapist who owns the company is not paying the full amount he owes me. He has been lying to me and other therapists about what he has and has not received from insurance companies for treatment services provided, and he owes me thousands of dollars for the services I have provided as a therapist. I have already given notice that I am leaving, but I am wondering what to do before and after I leave.

Ann Kiernan replies:

I can see several issues here. First, lack of timely payment, and second, whether you are really an independent contractor or should be an employee, instead. If you have not already done so, compile a spreadsheet or list of all the work you have done and not been paid for. You should also document what the owner has said and done about accounts receivable and worker payments. In addition, make copies of any handbook that applies to you. These documents will be very helpful when you pursue your claim for payment.

To get the best advice about your situation, consult a local employment lawyer. If you do not know one, contact your local county bar association or the National Employment Lawyers Association for some referrals. You also could contact the local state or federal wage and hour office for guidance. Good luck.
